Acceptance of Terms

By accessing and using Duskpix, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

Service Description

Duskpix provides AI-powered photo editing services for real estate photography. Our service includes image processing, enhancement, and transformation tools.

User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

Credits

A credit is what one finished AI edit costs. Credits you buy outright, as a top-up or a credit pack, do not expire. Credits included with a monthly plan are different: see "Monthly plans" below.

Monthly plans and automatic renewal

A monthly plan renews automatically each month, on the same date, at the price shown when you subscribed, until you cancel it. We charge the payment method you gave us at checkout. Current prices are on our Pricing page. We will tell you by email before the price of your plan changes, and you can cancel before the change takes effect.

Cancelling

You can cancel your plan at any time from billing settings. Cancelling takes effect at the end of the month you have already paid for, so you keep the plan and its credits until then. We do not charge a cancellation fee and we do not lock you into a minimum term.

What happens to plan credits when a plan ends

Credits included with a monthly plan belong to that plan. While your plan is running, unused plan credits roll over from one month to the next.

When your plan ends, for any reason, the plan credits left in your account stay usable for 7 more days. If you start a plan again within those 7 days, you keep them. Otherwise they finish at the end of that period. We email you when the plan ends, and again 2 days before the credits finish, so you know the date.

Credits you bought outright are not affected and stay in your account.

The rollover cap

Plan credits roll over up to three months of your plan's monthly allowance. Once you are holding that much, a renewal does not add more until you have spent some. You are still charged for the month, because the plan is what you are paying for.

Changing plans

You can move to a larger plan at any time. We charge the difference for the rest of the month straight away and add the matching share of the extra credits. Moving to a smaller plan takes effect at your next renewal, and we do not take away credits you already have.

Failed payments

If a payment fails we will retry it over the following days and email you. Your credits stay where they are while we retry. If the payment still has not gone through after the final retry, the plan ends and the paragraph above about plan credits, including the 7 days, applies.

Changing your mind about a plan

If you have just started your first plan and it is not for you, email hello@duskpix.com.au within 7 days of the payment and we will refund it in full, as long as you have used no more than 5 plan credits. Your plan then ends and its plan credits end with it. Credits you bought outright are not affected.

Refunds on credits you buy

Credits you buy outright, as a top-up or a credit pack, are not refunded for change of mind. They do not expire, so there is no deadline to use them. If an edit fails, its credit is returned to your account automatically.

Your rights under the Australian Consumer Law

Nothing here limits your rights under the Australian Consumer Law. Our services come with consumer guarantees that cannot be excluded. If a service fails to meet one of those guarantees you may be entitled to a refund, a repeat of the service, or compensation for reasonably foreseeable loss.

If something has gone wrong with a payment or an edit, email hello@duskpix.com.au and we will sort it out.

The one free revision on a completed AI edit is a product feature. It is not a limit on any remedy you are entitled to under the Australian Consumer Law.

Acceptable Use

You agree not to:

• Upload content that violates any laws or third-party rights
• Attempt to reverse engineer or exploit our service
• Use our service for any illegal or unauthorized purpose
• Share your account credentials with others

Intellectual Property

You retain all rights to the images you upload. We do not claim ownership of your content. However, you grant us a license to process and store your images as necessary to provide our service.

Uploaded images and edited results are stored for 12 months from the project's last upload or edit, after which they are permanently deleted. We will email the address on your account approximately 30 days before deletion. You are responsible for downloading and keeping your own copies to meet any record-keeping obligations that apply to you, which for real estate professionals commonly extend beyond 12 months.

Limitation of Liability

Duskpix is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of our service.

Governing Law

These Terms are governed by the laws of Queensland, Australia. You and Duskpix submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia in respect of any dispute arising from these Terms or your use of the service.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
